Double Jeopardy Deserved?

Prosecutorial
pit bull John Ashcroft, obviously with time on his hands despite the
war on terrorism, the fight for the Patriot Act, and the ongoing proceedings
against current miscreants, has been delving into the archives to find
underpenalized past cases to which he can apply the death sentence retroactively.
The latest such case involves the murderers of 10-year-old Jeffry Curley
of Cambridge.

If anyone could be said to be poster boys for capital punishment, short
of Timothy McVeigh or Usama Bin Laden, it is the two slimebags who kidnapped
and murdered this kid. Charles Jaynes, the convict Ashcroft is considering
bringing federal charges aginst, killed the Curley by sticking a gas-soaked
rag in his mouth after he refused the
man’s
sexual
advances.
Curley’s
body was placed in the trunk of Jaynes’s car, stuffed in a plastic container,
and then dumped into a southern Maine river.

Massachusetts does not have a death penalty.Although such a trial would
be highly unusual, even lawyers who oppose the death penalty conceded
yesterday that the government is within its rights to pursue the case,
because state and US courts are separate, sovereign judicial entities.

Prosecutors at the US attorney’s office in Boston declined to comment
yesterday on developments in the case.
