Various measures to fight terrorism such as travel bans and precautionary detention without trial often grab the headlines. Yet within the E.U. actions to freeze the assets of known and suspected terrorists have generated a substantial body of litigation and raised significant constitutional issues. Courts have been faced with many difficult questions and have responded with sometimes innovative and surprising answers.
