The European Court of Justice has long been criticized for its short judgments not explaining in enough detail the reasons for its decisions, particularly in comparison to the US Supreme Court. Come join the debate with prof. Vlad Perju, SJD ’07, who argues for a discursive turn in the ECJ’s legal reasoning. The argument addresses fundamental questions of judicial discourse, legal reasoning and legitimacy.

Abstract:
This Article makes the case for a discursive turn in European law. Contrary to the prevailing view, politicizing the judicial discourse of the European Court of Justice would strengthen, more than undermine, the Court’s authority. This argument is made with reference to the ECJ’s reason giving practice, specifically to the relation between the form and content of its decisions. Allowing its members to write separate opinions will enable the Court to redefine its role on the European institutional and political stages The Article then answers doctrinal, institutional and juriscultural objections to its central thesis.

Call for Papers: Law of the European Union

The Harvard European Law Association is seeking articles on EU law for online publication in the Harvard European Law Association’s internet site, http://www.law.harvard.edu/students/orgs/hela/workingpaper.html The working papers series is the precursor to an eventual EU Law Journal (ca. 5 years hence). Articles may be of any length. Book reviews and biographies or unscientific writings are not in the Working Paper Series’s ambit and cannot be considered. Political science works may be considered, exceptionally, where the topic is clearly of direct concern to lawyers and judges. Rigorous scientific standards are to be observed – an average of 4-6 notes per page, an abstract of the article in English, spacing 1.5, times new roman 12 pt, complete footnotes, not endnotes or inline notes. Articles without abstracts cannot be considered. Where possible, articles should include abstracts in more than one language. Bibliographies may be included but are not required. Articles may be submitted as doc, rtf, pdf or html. Articles will be considered in English, French, German Spanish and Italian. In those cases however an English language abstract must be provided. Editing will go to grammar and language only — non native English speakers’ articles will be grammatically corrected into standard international English by the editors. The editors will not be able to bluebook your work and works with incomplete and incorrect footnotes will not be considered. Inline notes (parenthetical style) is not acceptable. Ibid, Id. or Op.Cit. forms may be used or omitted. Correct numerotation of footnotes is the author’s responsibilty. The notes should be in the bluebook format, though British legal footnoting style is also acceptable. Electronic formatting is the principle responsibility of the author — essentially, presented works should be “camera ready copy”. Main text 12 point, times new roman, 1.5 line spacing, 10 point times new roman for footnotes.

In a public address at the Harvard Kennedy School, Jasmin Imamovic, mayor of Tuzla, Bosnia-Herzegovina’s third largest city, will share insights on post-conflict reconstruction, reconciliation and development in a multi-ethnic community. Since the 1992-1995 Bosnian conflict, Tuzla has been transformed into a regional model of community development, thanks to the Mayor’s policies. By promoting coexistence and tolerance, Mayor Imamovic has transformed the city, maintained its multi-ethnic character, and bridged partisan lines. US Experimentalism: A Governance

Visiting Researcher Mark Dawson from the European University Institute (Florence, Italy) will present on new modes of governance and law-making in the European Union.

In the last decade, the European Union has begun to experiment with new mechanisms for the agreement of EU laws. Perhaps the most significant has been the ‘Open Method of Coordination’ (OMC) – an instrument of ‘soft law’, designed to coordinate Member State action in sensitive policy areas. The OMC has significantly altered the basic model for EU law, focusing not on the agreement of common standards, but on the need to adapt European rules to a more local context, ‘experimenting’ with different policy solutions in the process.

This new focus has attracted US attention. It opens the door to a reading of the OMC as part of a new and ‘transformative’ stage in European integration; one where open and experimental legal standards become a central part of European law-making more broadly. On the other hand, the experimentalist framework has attracted some resistance – do the differences between the US and EU contexts make it unsuitable for European consumption? And do the basic tenets of experimentalism actually explain the operation of the OMC as it stands? In the presentation we will pose a question that has become central to Trans-Atlantic scholarship on ‘new governance’: can this particular model for legal reform either explain or guide vital changes in the EU’s governance architecture?
