Dear Mr. Graf, dear friends,
Last week Francesca read to us a portion of the transcript of another judicial interrogation in the matter of the investigation into the death of the child Joseph Abdulla. The witness was a young boy from Sebnitz, Daniel Steiner. The transcript has the Dresden district court file number 270 Gs 3141/00 414 Js 53329/00; the interrogation was carried out on 21 November 2000, at ten o’clock in the morning.
Francesca continued with the reading from the point where she had ended last week, having pointed out to us that the next few questions and answers seemed to her to be somewhat irrelevant, though she thought it was important to read them to us. The problem is, she said, that the outside documents to which the questioners refer, are not quoted in full in the transcript. As a result, it is sometimes a little difficult to follow the thread of a few of the questions. Of course with these questions, though, the questioners were attempting to test the accuracy of the witness’ memory:
In response to a question about where the three went, when Joseph was recovered (from the water): “They beat it, went away. Normally, so that it wouldn’t look unusual.”
In response to a question about whether they had sneaked away: “Yes, you could say that.”
In response to a question about when the three had left: “When they saw all of that, and Ronny Siebert was along, and the pool attendant came, they were gone. I saw that.”
In response to a follow-up question: “The story went around that Kai Bleschke, Ronny Kunte and Rene Großmann pulled Joseph out (of the water). But that’s not right. He was pulled out by myself and Antonio Keleman.”
In response to a follow-up question relating to page 284 of the files, where it reads “I saw . . .”: The part about the landing is right, but when Ronny went along there, that isn’t right. The part about Ronny going along there, that isn’t right.”
In response to a follow-up question relating to the files, where it reads, “From that point on he went into the water . . .”: “That’s right. The sentence before that isn’t right. It wasn’t Ronny Kunte and Kai Bleschke that went to the place, but Sandro Richter and Maik Hauke.”
In response to a follow-up question concerning what the witness had said about the elder Thalheim couple selling things there that day (at the kiosk): “That’s right. We got some French fries there.”
In response to a follow-up question about whether or not he might be mistaken: “It was the older Thalheim couple.”
In response to a follow-up question about the Thalheims’ probably being away at a health spa: “I’m sure that it was the older couple.”
In response to a question by Inspector Krebs about where the towel was that Joseph was carried in: “It didn’t go into the water with Joseph. It lay on the edge of the pool.”
In response to a question by Inspector Krebs about the color of Joseph’s bathing suit: “Maybe blue.”
In response to a question by Inspector Krebs about swim fins and a face mask: “Swim fins, no. But a face mask and a snorkel.”
In response to a question by Inspector Krebs about whether Joseph had a face mask when he was taken from the pool: “No.”
In response to a question by Inspector Krebs about whether he (the witness) had seen Joseph when the two were jumping on him: “I saw where Joseph fell in(to the water) and then I thought to myself that they could only be jumping on Joseph.”
In response to a question by Inspector Krebs: “I can dive to around ten meters.”
In response to a question by Inspector Krebs about the fact that the witness must have seen that Joseph didn’t come up again: “I went to another place and there I didn’t see that.”
In response to a question by Inspector Krebs about whether the witness had seen Joseph getting some air again when he was in the water: “Of course that went through my head when I went over to my place.”
In response to a question by Inspector Krebs about whether they had only been teasing Joseph and were jumping next to him: “I don’t think so. The way they grabbed on to him, it was serious.”
In response to a question by Inspector Krebs about whether they had really hit the body: “I don’t know, but it was clear to me.”
In response to a question by Inspector Krebs about whether the witness could stand in the swimming pool: “No, I was shorter then, and Joseph was just seven.”
In response to a question by Inspector Krebs about whether Joseph had come up again: “I didn’t see that.”
In response to a question by Inspector Krebs about whether you could tell by looking at him that Joseph was a foreigner: “He was really brown, dark hair, small nose. You couldn’t tell right away that he was a foreigner. You couldn’t tell that about Diana either, his sister. But you could tell it right away about his father.”
In response to a question by Inspector Krebs about why they had done such a bad thing to Joseph: “Because he was a foreigner.”
In response to a question about whether they had said something along that line in the swimming pool: “Yes. ‘You shit foreigner, we’re going to kill you’.”
“That’s enough for today,” said Francesca, her voice choking. “Next week I’ll read more.”
“In any case,” I said, I have to say that I believe the great Kurt Biedenkopf, former prime minister of Saxony, when he said that ‘his Saxons’ could never have done anything so terrible and that if any media outlet claimed that ‘his’ people were capable of such a thing, he would take the media to court and sue them for twenty million dollars.”
For a moment, Francesca was so angry she could hardly speak. She looked at me, her eyes narrowing. “My God, you’re an old fool,” she said softly.
I felt deeply hurt.

Sehr geehrter Herr Graf, sehr geehrte Freunde,
Francesca hat letzte Woche einen Teil eines Protokolls uns vorzulesen. Es war das Protokoll noch einer richterlichen Zeugenvernehmung in der Todesermittlugnssache des Kindes Joseph Abdulla, Geschäftszeichen des Amtsgerichts Dresden: 270 Gs 3141/00 414 Js 53329/00, am 21.11.2000 um 10.00 Uhr durchgeführt.
Sie fuhr mit dem Vorlesen fort, wo sie letzte Woche aufgehörte, nachdem sie uns gesagt hatte, dass die nächsten paar Fragen und Antworten ihr etwas irrelevant zu sein scheinen. Sie dachte aber, es sei wichtig, sie uns vorzulesen. Das Problem, sagte sie, liege darin, dass die Akten, auf die die Fragesteller sich beziehen, nicht in diesem Protokoll völlig zitiert seinen. Aus diesem Grund ist es manchmal etwas schwierig, dem Gesprächsfaden zu folgen, wo es um bestimmte Fragen geht. Natürlich aber mit diesen Fragen versuchten die Fragesteller, die Genauigkeit der Erinnerung des Zeugen zu prüfen:
Auf die Frage, wo die drei hin sind, als der Joseph gebor(g)en war: Die sind abgehauen, gegangen. Normal, so dass es nicht auffällt.
Auf Frage, ob sie rausgeschlichen sind: Ja, das kann man so sagen.
Auf die Frage, wann die drei weg sind: Wo die das alles gesehen haben und der Ronny Siebert mit hin ist und die Bademeisterin kam, sind die weg. Das habe ich gesehen.
Auf Vorhalt: Es ging rum, dass der Kai Bleschke, Ronny Kunte und Rene Großmann den Joseph rausgeholt hätten. Das stimmt aber nicht. Rausgeholt wurde er von mir und dem Antonio Keleman.
Auf Vorhalt Blatt 284 der Akte, „Ich habe gesehen . . .“: Das auf dem Podest das stimmt aber als der Ronny mit hingegangen ist, das stimmt nicht. Dass der Ronny mit hingegangen ist, das stimmt nicht.
Auf Vorhalt „Ab dann ist er ins Wasser gegangen . . .“: Das stimmt. Der vorherige Absatz stimmt nicht. Nicht der Ronny Kunte und der Kai Bleschke sind zu dem Platz, sondern der Sandro Richter und der Maik Hauke.
Auf Frage, dass der Zeuge gesagt hätte, dass die älteren Thalheims den Tag dort verkauft hätten: Ja, das stimmt, wir haben dort Pommes geholt.
Auf Frage, ob er sich irren kann: Das waren die alten Thalheims.
Auf Vorhalt, dass die älteren Thalheims wahrscheinlich zur Kur waren: Ich bin sicher, dass es die älteren waren.
Auf Frage KHK Krebs, wo das Badetuch blieb, mit dem der Joseph hingetragen wurde: Es ist nicht mit dem Joseph ins Wasser gefallen. Es lag am Beckenrand.
Auf Frage KHK Krebs, was der Joseph für eine Badehose an hatte: Eine blaue vielleicht.
Auf Frage KHK Krebs nach Badelatschen, eine Taucherbrille: Badelatschen nein. Aber eine Tacherbrille und ein Schnorchel.
Auf Frage KHK Krebs, ob der Joseph beim rausholen aus dem Becken eine Taucherbrille hatte: Nein.
Auf Frage KHK Krebs, als die beiden raufgesprungen sind, ob er den Joseph gesehen hat: Ich habe gesehen, wo der Joseph reingefallen ist und da habe ich mir gedacht, dass die nur auf dem Joseph rumspringen können.
Auf Frage KHK Krebs: Ich kann ca. 10 Meter tauchen.
Auf Frage KHK Krebs, dass der Zeuge ja gesehen haben muss, dass der Joseph nicht wieder aufgetaucht ist: Ich bin zu einem anderen Platz gega(n)gen und da habe ich das nicht gesehen.
Auf Frage KHK Krebs, ob der Zeuge gesehen hat, dass der Joseph noch mal Luft geholt hat, als er im Wasser war: Natürlich ging mir das durch den Kopf, als ich zu meinem Platz hingegangen bin.
Auf Frage KHK Krebs, ob die vielleicht nur den Joseph geärgert haben und daneben gesprungen sind: Das glaube ich nicht. Schon wie die den angesackt haben, das ist ernst.
Auf Frage KHK Krebs, ob die den Körper richtig getroffen haben: Das weiß ich nicht aber es war klar für mich.
Auf Frage KHK Krebs, ob der Zeuge in dem Becken stehen konnte: Nein, da war ich noch kleiner und der Joseph war erst 7.
Auf Frage KHK Krebs, ob der Joseph noch einmal hochgekommen ist: Das habe ich nicht gesehen.
Auf Frage KHK Krebs, ob man dem Äußeren sah, dass der Joseph Ausländer war: Der war eben ganz schön braun, dunkle Haare, kleine Nase. Man konnte nicht sofort erkennen, dass es ein Ausländer war. Auch bei der Diana, bei der Schwester, erkennt man das nicht aber bei dem Vater.
Auf Frage KHK Krebs, warum die mit dem Joseph so eine schlimme Sache gemacht haben: Weil er ein Ausländer war.
Auf Frage, ob die was in dem Bad in der Richtung gesagt haben: Ja, du scheiß Ausländer, wir bringen dich um.
„Das reicht für heute,“ sagte Francesca, mit vor Erregung versagender Stimme. „Nächste Woche werde ich weitervorlesen.“
„Auf jeden Fall,“ sagte ich, „muss ich sagen, dass ich dem großen ehemaligen Ministerpräsident von Sachsen, Kurt Biedenkopf, glaube, als er sagte, dass ‚seine Sachsen’ etwas so Schreckliches hätten nie tun können und dass er jeden Medienkonzern, der das Gegenteile verbreitete, vor Gericht bringen und zwanzig Millionen Dollar Schadenersatz verlangen würde.“
Einen Augenblick brachte Francesca vor Wut fast keinen Ton heraus. Dann, mich mit zusammengekniffenen Augen anschauend, „Mein Gott, bist du ein alter Trottel,“ sagte sie leise.
Ich fühlte mich zutiefst betroffen.
