Continuation of the letter of last week:
“The German government has supported the idea of the cancellation of billions of euros of debt owed to various banks. This was done by appealing to a moral duty toward the Iraqi people. In the same way, I appeal to a moral duty that Germany has toward its citizens of foreign extraction.
“I repeat: it cannot be said that our problem is a purely private banking matter. That is a simplification. The case of our son Joseph was a political affair, it was a murder carried out by right-wing extremists at public swimming pool. The truth of it was concealed with the help of the justice system in Saxony and through the political influence of its former minister-president, Kurt Biedenkopf, who said, “Saxony is immune to right-wing extremism,” and who wanted to preserve the supposedly good reputation of eastern Germany.
“German politicians are constantly reminding us all that we must learn from our past, that we must not forget the past, and that we must confront it. Your recent visit to Israel, Mr. President, and to the memorial to Jews murdered by the Nazis – to countless children murdered by the Nazis – should also be a reminder and a confirmation of these ideas.”

„Von Seiten der deutschen Regierung wurde ein Schuldenerlass der Banken in Milliardenhöhe für den Irak propagiert. Wird hierbei mit einer moralischen Verpflichtung dem irakischen Volk gegenüber argumentiert, so berufe ich mich hier auf die moralische Verpflichtung Deutschlands gegenüber seinen deutschen Staatsbürgern ausländischer Herkunft. Ich wiederhole mich. Es darf nicht argumentiert werden, dass unser Problem eine reine Privatangelegenheit der Bank sei. Dies ist zu einfach. Der Fall Joseph ist und war ein Politikum, ein von Rechtsradikalen im Schwimmbad verübter öffentlicher Mord, der mit Hilfe der sächsischen Justiz und auf Grund des politischen Einflusses des ehemaligen Ministerpräsidenten Herrn Biedenkopf, ich zitiere: “Sachsen ist immun gegen Rechts.” zum wirtschaftlichen Wohle Ostdeutschlands vertuscht wurde.
Deutsche Politiker führen immer wieder vor Augen, dass wir Deutsche aus der Vergangenheit lernen, die Vergangenheit nicht vergessen, uns ihr stellen müssten. Ihr Besuch des Staates Israel, der Gedenkstätten der von Nazis ermordeten Juden, den von Nazis ermordeten unzähligen Kindern sollte dies verdeutlichen. Mein Sohn reiht sich in die Reihen dieser um ihr Leben betrogenen Kinderseelen ein.“

“Please do not try to tell us that you are powerless in all this. It is hard to believe that the President of Germany, a man who knows who to deal with delicate matters of world politics, is condemned to impotence when it comes to matters at a national level and is reduced to reminding people of his duty not to become involved.
“I have to say again that my family was driven from Saxony by Nazis, and that the foreclosure on our property will inevitably push us into financial ruin, if nothing is done about the situation now. Either a cancellation of the debt or a purchase of the property by the government of Saxony would be two possible solutions to the problem.”

„Versuchen Sie bitte nicht, mir vor Augen zu führen, dass sie in dieser Angelegenheit keine Verfügungsgewalt oder Macht besitzen. Es ist schwer zu glauben, dass der Bundespräsident sich in heiklen, weltpolitischen Fragestellungen einzubringen weiß, Stellung bezieht, aber auf nationaler Ebene zum Scheitern verurteilt ist und sich auf seine politische Nichteinmischungspflicht beruft. Ich wiederhole, meine Familie wurde aus Sachsen von den Nazis vertrieben, die Zwangsversteigerung unseres Anwesens wird meine Familie unweigerlich noch mehr in den Ruin treiben, wenn dem nicht unverzüglich entgegengewirkt wird. Schuldenerlass oder Kauf von Seiten der sächsischen Regierung sind zwei mögliche Lösungen des Problems.“

“Finally, let me mention a related matter: I have also attached to this letter a message I received from the court in Dresden that is responsible for property foreclosures. The message is dated 1 February 2005 and in it the value of our building at Rosenstrasse 11 in Sebnitz is estimated at about 205,000 euros.
“However, what we invested in remodelling the building so that it would include living quarters and a pharmacy amounted to 1,150,000 euros. Half of that was a down payment we made ourselves, and the other half was a mortgage from EuroHypo Bank in Leipzig. If the property is sold for 205,000 euros, it represents a squandering of the money we invested. In other words, the building is being offered for sale for almost nothing. Worse than that, though, is the fact that we will be responsible, for the rest of our lives, for repaying the remainder of the mortgage we received from EuroHypo Bank, a mortgage on property that no longer belongs to us. And this property, which will be sold for a fraction of its value, was meant to provide for our future and the future of our children, Joseph and Diana. If and when that happens, the tragedy surrounding the family of the boy Joseph will reach what may be its nadir.”

„Ich habe letztlich ein Anschreiben vom Amtsgericht Dresden/ Zwangsversteigerungs-abteilung erhalten, datiert auf den 01.02.2005 (Anlage II), in dem der Verkehrswert unseres Hauses Rosenstr. 11 in 01855 Sebnitz auf rund 205.000,— Euro geschätzt wird.
Die von uns in die Immobilie Rosenstr.11 – einschließlich der integrierten Apotheke – investierte Gesamtsumme beläuft sich auf rund 1.150,000 Euro. Die Hälfte dieses Betrages wurde als Eigenkapital geleistet, die zweite Hälfte wurde durch EuroHyp / Leipzig als Darlehen zur Verfügung gestellt. Der festgesetzte Versteigerungswert von 205.000,— Euro stellt somit eine Vermögensverschleuderung des Schuldners dar. Das Haus wird für einen Apel und Ei angeboten. Dazu werden wir verpflichtet lebenslang die Restschulden für ein Haus, das uns nicht mehr gehört, zu tilgen. Das Anwesen, das wir für eine gesicherte Zukunft unserer Kinder Joseph und Diana gebaut haben, wird zum Niedrigstpreis verhökert. Damit hat die Tragödie um die Familie Joseph Abdullas einen neuen Höhepunkt erreicht.“

“I still place my hopes in Germany as a country based on the rule of law, as a country that is now dedicated to justice and human rights, and I hope you will not betray these hopes.
“Your message of 19 January 2005, which is attached to this letter and which was written in response to my appeal of 13 December 2004, seemed to us somewhat hurtful and composed in a way that was unexpectedly harsh and inappropriate.
“Putting my faith and trust in you, I have written to you once more because you are the chief representative of the German people. You are a person who believes in justice and order, who has supported human rights all over the world, and I ask you to make an effort on our behalf. In my earlier letter, I asked for your intervention in the ongoing deprivation of my family’s rights. You responded only to the surface difficulty, saying that you cannot become involved in “banking matters.” However, this case is not that simple, and dare I say that you must not make it that simple. The power of the neo-Nazis in Saxony and the inability of the political elite to deal with the problem show what the deeper implications of this affair really are.”

Ich habe Ihnen geschrieben, im Glauben und Vertrauen, dass Sie als höchster Repräsentant des deutschen Volkes, der an Recht und Ordnung glaubt, der weltweit für die Einhaltung von Menschenrechten eintritt, sich für meine Anliegen einsetzen würden. Ich bat um eine konstruktive Intervenierung Ihrerseits hinsichtlich der fortgesetzten Entrechtung meiner Familie. The murderers are allowed to run free, and they have been assured that they will never in any way be called to account for their crime.
It is indeed sad that a seven-year-old boy was killed and that other foreigners in Germany have to put up with derogatory remarks, offensive behavior, and worse. However, it would hardly be an exaggeration to say that when such things happen in Germany today, and the political elite either will not or cannot correct these situations, even retroactively, then these are events that cry to heaven for justice and show that something is rotten with the German state.
I hope that if you are unable or perhaps unwilling to seek justice for a murdered boy, you will at least be in a position to show some consideration for those he left behind.

Die Mörder laufen frei herum, denn man hat ihnen versichert, dass sie für ihre Taten in keinerlei Hinsicht nie und nimmer zu Rechenschaft gezogen werden.
Angesichts der traurigen Tatsache, dass ein siebenjähriger Junge sein Leben lassen musste (und andere Ausländer tagtäglich mit abfälligen Bemerkungen und Überschreitungen zu kämpfen haben), stinkt das Verhalten Deutschlands und seiner Justiz, das Unvermögen und der Widerwille der politischen Elite wenigstens im Nachhinein Recht walten zu lassen bis zum Himmel hinauf.
Ich hoffe, dass wenn Sie der Erfüllung des Rechts gegenüber dem Ermordeten nicht einzulösen vermögen oder wollen, Sie wenigstens Gnade mit den Lebenden haben werden.

Anyone can try to avoid facing the truth of our situation, but the reality of it remains. Everything we are now suffering was caused by the murder of my son and by a German justice system and a Saxon government that allows a German-Arab family to be deprived of its rights. To make matters worse, that system and that government remain virtually silent in the face of increasing neo-Nazi dominance in Saxony, where neo-Nazi party members even sit in the state legislature in Dresden.
Through the efforts of the authorities, the murder of my son Joseph has metamorphosed into a “trifle,” a “swimming pool accident,” in order to stifle any possible international reaction and to guarantee that Germany has an untarnished reputation. Attention has turned away from the neo-Nazis who murdered my son. Discussion of their crimes has become a public debate about the legal niceties of trying once more to have the German Supreme Court ban neo-Nazis as an organized political entity.

Unsere jetzige Situation lässt sich immer wieder auf die Ermordung meines Sohnes zurückführen, auf die von der deutschen Justiz und dem Staat Sachsen geduldete Entrechtung einer deutsch-arabischen Familie und ihrem Stillschweigen gegenüber der rechten Dominanz. Die Ermordung meines Sohnes Joseph wurde als “Bagatelle” in einen “Badeunfall” umformuliert, um die internationale Resonanz auf diesen Skandal zu bändigen bzw. aufzuheben, stets bedacht darauf, Deutschland einen Platz an der Sonne zu garantieren. Continuation of the letter of last week:
We have been registered as a bad credit risk with Germany’s main consumer credit-rating agency, and this has made it impossible to do such things as lease an automobile or open a simple bank account for business purposes.
Despite the obstacles we faced, my family and I took the risk of making a new start in western Germany, at the same time that we tried to repay the money that had been loaned to us. Even though we did all we could, EuroHypo Bank is now going to foreclose on our property at Rosenstrasse 11 in Sebnitz, the property we were forced to abandon.
It is clear from bank correspondence, that we have always tried to meet the mortgage payments and that we have tried either to rent out or sell the property, as the bank wanted us to do. However, you will perhaps agree with me when I say that it is enormously difficult, even perhaps impossible, to sell or rent a building in a small German town when that building is indelibly connected with our family, with the murder of my son, and with the campaign of slander directed against us.

So wurden unsere Personen in der Schufa registriert, was die Eröffnung eines einfachen Geschäftskontos oder den Abschluss eines simplen Leasingvertrages für ein Auto unmöglich macht.
Trotz der Hindernisse haben meine Familie und ich einen Neuanfang in Westdeutschland gewagt, im Bestreben die Kredite zurückzubezahlen. Doch all unseren Anstrengungen zum Trotz, sehen wir uns nun mit einer von der EuroHypo Bank veranlassten Zwangsversteigerung unserer Immobilie Rosenstrasse 11 in Sebnitz konfrontiert. Aus der Korrespondenz mit den Banken geht hervor, dass wir stets bemüht waren, die monatlichen Tilgungsraten zu begleichen und die von der Bank geforderte Vermietung bzw. den Verkauf des Objekts anzustreben. Doch Sie werden mir in diesem Punkt wohl zustimmen, dass es ungeheuer schwer ist, ja fast ausweglos scheint, dieses Haus, das unweigerlich mit unserer Person, dem Mordfall und der Rufmordkampagne in Zusammenhang gebracht wird, zu vermieten bzw. zu verkaufen.

Continuation of the letter of last week:
“Even though I am certain you have heard the story many times before, I would like once more to summarize everything that is known about our situation.
“In the name of what is supposed to be German justice, two official investigations were conducted into: “Death of Joseph Abdulla, Citizenship: Iraqi.” An impartial review of the available files, however, makes it clear that a just conclusion of these investigations was intentionally thwarted. Regrettably, this does not appear to be unusual. One reason may be a lack of interest on the part of the authorities. Another reason may be the quite perfidious attitude of the justice ministry in Saxony, which has apparently concluded that it is not worth the trouble to truthfully explain the murder of a boy who was of mixed German and foreign background. And if the latter is true, one can perhaps conclude that this must be the result of residual thought processes inherited from Germany’s Nazi past.
“The government of Saxony conducted a media campaign of defamation and slander against our family. Because of this, and because of repeated death threats, we were forced to abandon our pharmacy business in Sebnitz and to move away from the town. The result of that move was to virtually destroy our very existence, since we lost our source of income and were faced with problems in repaying the mortgage on the property we were compelled to abandon.”

Fortsetzung des Briefes:
„Auch wenn ich mir sicher bin, dass es Ihnen nun sprichwörtlich zum Halse heraushängt, werde ich das Offensichtliche nochmals unmissverständlich formulieren.
Die zweimalig im Namen der so genannten deutschen Rechtstaatlichkeit durchgeführten Ermittlungen in der ich zitiere “Todessache Joseph Abdulla; Staatsangehörigkeit: irakische ” wurden von der deutschen Justiz – nachvollziehbar anhand der Ermittlungsakten – absichtlich vereitelt. Eine zu meinem Bedauern scheinbar übliche Vorgehensweise, sei es aus Gründen des Desinteresses oder der perfiden Einstellung der sächsischen Justiz, die einen Mord an einem Kind ausländisch-deutscher Herkunft nicht für aufklärungswürdig hält. Ich persönlich führe dies auf ein resistentes Nazigedankengut zurück.
Auf Grund der vom Staat Sachsen geförderten medialen Rufmordkampagne und der wiederholten Morddrohungen gegen unsere Person, war meine Familie gezwungen unsere in Sebnitz ansässige Apotheke aufzugeben und wegzuziehen. Die daraus resultierenden Existenz vernichtenden Konsequenzen, nämlich den Verlust des Arbeitsplatzes und damit der Geldquelle, erzeugten zudem Probleme mit den finanzierenden, Kredit währenden Banken.“

Dear Mr. Graf, dear friends,
Continuation of the letter of last week:
“I am asking you to use your powers to oppose the obfuscation of the truth and to prevent a German-Arab family from being deprived of its rights. I am asking you not to close your eyes to the murder of my son, committed by right-wing extremists, even though many politicians did exactly that at the time the murder was being presented in the media. Please give us, the parents and the sister of the murdered boy, some peace and closure.
“Please do all you can to extricate our family from the problems facing us, including the absurd difficulty of being forced by the government of Saxony to pay for property that we no longer occupy, since we cannot occupy it without endangering our lives.
“We were driven from Sebnitz and Saxony and cannot return there. We ask you to convince the government of Saxony that it would be just and right to at least purchase the property. We can no longer live and work in Sebnitz but we are compelled to go on making mortgage payments on a building we once lived and worked in.”

„Ich bitte Sie sich der Verschleierung der Wahrheit, der öffentlichen Entrechtung einer deutsch-arabischen Familie entgegenzusetzen. Ich bitte Sie, nicht die Augen vor dem von Rechten verübten Mord an meinem Sohn Joseph zu verschließen, wie etliche Politiker es zum Zeitpunkt der medialen Veröffentlichung des Mordfalles getan haben. Geben Sie den Eltern und der Schwester des Ermordeten endlich etwas Ruhe, verhelfen Sie ihnen endlich zu etwas Frieden, und veranlassen Sie den Staat Sachsen unsere Anwesen in Sebnitz zu einem angemessenen Preis zu kaufen, oder wie auch immer Sie dieses Problem zu lösen vermögen. Wir bezahlen für einen Besitz, den wir nicht besitzen, da wir dort nicht ohne Gefahr um Leib und Leben wohnen, geschweige denn arbeiten können. Wir wurden aus Sebnitz und Sachsen vertrieben und können dorthin nicht zurückkehren.“

Mr. Saad Abdulla, father of the boy Joseph, recently wrote the following letter, which has already been reprinted here but which perhaps bears further attention:

“In the letter that I addressed to you on 13 December 2004, I presented myself less as someone begging for something, and more as one seeking a favor.
“By law, you have the right and the duty to represent the democratic foundation of the German Federal Republic, a state based on the rule of law. You also have the right and the duty to guarantee that democratic foundation and to see that it is maintained.
“You are the highest authority responsible for the rule of law in Germany, one who has the power to ensure that the rule of law is adhered to. I have therefore asked you, and I ask you now, to use all of your powers and privileges of office to assist a family that has been deprived of its rights.
“My son was murdered by an organized band of right-wing extremists in Germany. Despite the current discussion of the renewed problem of right-wing groups in Germany, and their growing organization, it seems to me that the efforts of the mainstream political parties are not even addressing the most superficial activities of the anti-democratic forces in Germany. Moreover, these efforts are failing to prevent the existence of those forces and are not dealing with them effectively as they grow more powerful. It is true that German politicians are calling on the public to show courage in confronting neo-Nazis and other extremists; however, the government itself offers no help when citizens dare to defend themselves against these extremists – or, in our case, to investigate with absolute thoroughness a murder these extremists committed at a public swimming pool in Sebnitz.”

Sehr geehrter Herr Bundespräsident,
in dem von mir an Sie adressierten Anschreiben vom 13.12.2004 trat ich weniger in der Rolle des Bettlers als in der des Bittstellers auf. Ihnen wurden per Gesetz das Recht und die Pflicht zugesprochen, die demokratischen und rechtsstaatlichen Grundsätze der Bundesrepublik Deutschland zu repräsentieren, zu garantieren und für deren Einhaltung einzustehen. Als oberstes Kontrollorgan der Rechtstaatlichkeit und letzte rechtstaatliche Instanz bat und bitte ich Sie daher, all Ihre Kraft und Ihre amtlichen Privilegien aufzuwenden, einer in jeder Hinsicht entrechteten Familie zu helfen. Mein Sohn wurde von organisierten Rechtsradikalen ermordet. Trotz der zurzeit wieder aktuellen Problematisierung und Diskussion über rechte Gruppierungen und ihre zunehmende strukturelle Organisation in Deutschland, scheint mir, dass die parteilichen Bemühungen weder die Oberfläche dieser antidemokratischen Kräfte ankratzen noch tiefer auf das Thema der wirksamen Prävention und Beseitigung dieser Kräfte eingehen wollen. Von Seiten der politischen Elite wird zum mutigen Vorgehen gegen den rechten Pöbel aufgerufen. Doch wo bleibt die Hilfe, wenn Mitbürger es wagen sich gegen Rechts zu wehren, einen von Rechten im öffentlichen Bad in Sebnitz verübten Mord aufzuklären und zu veröffentlichen.“

Dear Mr. Graf, dear friends,
Continuation of a report broadcast by the program “Kontraste” over the Rundfunk Berlin- Brandenburg television network on 28 August 2005, written by Alexander Kobylinski and Caroline Walter. The report indicates what sort of atmosphere existed in a town that is located a few kilometers from Sebnitz, even at the time Joseph and his parents were living there and when Joseph died:
“Manfred Lindemann of Saxony’s Network against Right-Wing Extremism: ‘It is not acceptable for the police to behave toward our citizens in this way, when a call goes in to police headquarters. The police have to react. They have to establish the facts. And if a mistake is made, all right, then they have to explain what happened. But this neglect of responsibility cannot simply go on for years on end. This has almost become a kind of illness where the police are concerned.’
“KONTRASTE Comment: Right now in Pirna, it’s the neo-Nazis who feel safer and more secure than anyone does. Here they are in front of a supermarket, a well-known place for the Nazis to congregate. They’re threatening our reporters and camera team with beatings, calling us “Jews” from Berlin.
“Just your average day in lovely Pirna.
“There are two possible reasons for this whole situation: either the police have no confidence in their own powers, because their forces are spread too thin, or else they’re simply looking the other way. Now you, in our television audience, can decide which is worse.”
(NOTE: Since the time of this broadcast, Kontraste has since reported that the situation in Pirna has improved. Whether it’s improved enough to prevent the death of a child like Joseph in the future, that is perhaps another question.)

Sehr geehrter Herr Graf, sehr geehrte Freunde,
Fortsetzung eines Beitrags der „Kontraste“-Sendung vom 28.08.2005 über den Rundfunk Berlin Brandenburg gesendet, ein Bericht von Alexander Kobylinski und Caroline Walter. Der Bericht weist darauf hin, was für eine Atmosphäre existierte, in einer Stadt ein paar Kilometer von Sebnitz entfernt, auch in der Zeit, wo Joseph und seine Eltern dort wohnten, und wo Joseph starb:
„Manfred Lindemann, Netzwerk Sachsen gegen Rechtsextremismus: ‚Es kann nicht angehen, dass wenn Anrufe bei der Polizei eingehen, in dieser Form gegenüber dem Bürger so reagiert wird. Die Polizei hat zu regieren. Sie hat die Tatbestände aufzunehmen. Und wenn einmal ein Fehler passiert, in Ordnung, dann muss man das klären. Aber nicht über Jahre darf diese Verschleppung, das ist schon fast eine Krankheit innerhalb der Polizei.’
Sicher fühlen sich in Pirna im Moment vor allem die Rechtsextremen. Auch wir werden angepöbelt. Vor einem Supermarkt, einem bekannten Nazitreff. Sie drohen mit Prügeln, beschimpfen uns als Juden aus Berlin.
Alltag im schönen Pirna.
Es gibt ja nur zwei Möglichkeiten: entweder die Polizei dort traut sich nicht, weil sie überfordert ist. Oder – die Beamten schauen mit Absicht weg. Und Sie können sich jetzt selbst aussuchen, was schlimmer ist.“
(Anmerkung: „Kontraste“ hat inzwischen berichtet, dass die Lage in Pirna sich verbessert hat. Ob sie sich genug verbessert hat, um den Tod eines Kindes wie Joseph zukünftig zu verhindern, das ist vielleicht eine andere Frage.)
