filed my brief, felt good about what i said and how i said it, cold water from jason worried about offending, disappointment from phil that he hadn’t had his chance at it, nothing back from anyone else; suppose i’m just wrong, the merits don’t count because they are not being presented right, that can’t be, or can it; is the fact that my style is not that of a law firm a strike against me?

just felt power from the dealer’s position, pushed in with a bet six times larger than the limpers, poker a betting game depending a lot on position, looking either for a good hand or good position with what you see as weakness already shown in front of you where they see strength from you and even if they think you are bluffing have nothing to bluff you out with but a bluff of their own, which you’d best watch for, and watch for the guy doing the position play to be vulnerable to it. i wish i had full feel for it, for the variation of how the cards play into the betting game as the tournament moves along, the sit and go table a training marvel. see and feel the basic move from dealer’s position when the action is limped around to you

Orlowski observes:

Copyright and the statutory damages framework are unchanged – as they were after the Tenenbaum verdict, in which Nesson had vowed to “put the record industry on trial.” Thomas-Rasset maintains her innocence in defiance of all reason – part of the reason for the original guilty verdict three years ago was that her peers felt she was insulting their intelligence, and wasting public money by bringing such a weak case to court. The plaintiffs will never see the damages, and don’t want it anyway. The defendant’s lawyers have been working pro bono, so there’s an opportunity cost for them, too.

an addition to the Register piece – subsequent to the initial rejection of my amicus offering, Judge Davis accepted my amicus brief, asked the riaa to respond, to which, when they did, i replied. The issues are now finally coming clear. Four trials now demonstrate that the court’s misapplication of the copyright law predictably leads to wildly excessive unconstitutional verdicts. Something is obviously wrong.

Orlowski concludes, “Nobody has become richer, or wiser. And Thomas-Rasset insists it must drag on. ® “

One can see that Orlowski does not play poker. as bob seger sings in face the promise, you won’t stop there. game still on.

No amount of money, police powers, weaponry, wishful thinking or pseudo-science will make our streets safer, only an end to prohibition can do that. How much longer are you willing to foolishly risk your own survival by continuing to ignore the obvious, historically confirmed solution? As a rough note to get things started, here is a (probably non-exhaustive) list of things we need to produce/discuss:

1. Request for leave to file reply to plaintiffs’ opposition to our amended counterclaim (ASAP!)
2. Request for leave to file reply to plaintiffs’ opposition to our motion to add RIAA (ASAP!)
3. Request for leave to file reply to plaintiffs’ opposition to our discovery plan (if we chose to do so, and if that is even possible… ASAP!)
4. Produce all three of those documents
5. Figure out what to do if we want to appeal the order against Tova to the 3rd Circuit (if we choose to do so)
6. Figure out how to comply with plaintiffs’ proposed discovery plan, because I think Judge Gertner probably will either adopt their plan or a modified version (provided we don’t/cant reply)
7. Figure out how to prepare all of the discovery stuff we’ll need to do soon anyway (esp. preparing expert reports on our experts)
8. How we’re going to handle the hearing in RI, including whether we’re going to request electronic recording
9. Finalize plans for our motion to allow electronic recording of the D.Mass proceedings
10. Decide how to distribute/coordinate all of this stuff with finals/Xmas break looming

Hi Will,

Bad news on that front – the audio we captured, starting with Charlie’s speech to the camera, is unrecoverable. The incompatible mic adapter HLS media services provided didn’t do the job expected, in spite of the fact that during operation last night everything seemed to be working fine. I’m completely redoing the setup and will test every link in the chain to make sure this doesn’t happen again. If the video without audio will be of any use to you, I can of course provide you with that, but no dice aside from that.

I’ll see you tomorrow and we can test things.

exciting news. at our ABRAHAM_OBAMA party wednesday will be andrew brokos, my best living proof next to howard lederer that poker is a game of skill, known online as foucault, the poker philosopher. who is currently playing in the world series of poker. he is returning to boston on monday and will come to our party. it’s a great opportunity for us to hear his stories and celebrate his achievements at the tournament. if you know anyone who would be interested in meeting him or playing poker please invite him or her to join us at galleryXIV 450 harrison st in the south end at 7pm on Wednesday JULY !6 2008. fern and i will provide wine beer snacks. and hopefully music. please respond with thoughts suggestions contributions of any sort and please try to attend. we’ll have a lot of fun.
