The Berkman Center, DPLA Steering Committee, DPLA Secretariat, and review panel, including their members and observers, are under no obligation to maintain the confidentiality of the submitted abstracts or other materials you provide. Please do not submit any information in your submission that is confidential or proprietary. All submissions are subject to the Intellectual Property Policy below. As described above, you must certify along with submission that you have read and agree to the IP Policy, and you must grant the Berkman Center, DPLA Steering Committee, and the DPLA Secretariat the license specified below to use your submission to carry out the DPLA’s work.

Intellectual Property Policy

This IP policy is intended to state the manner in which intellectual property presented or submitted to the DPLA Beta Sprint will be handled and to specify the license that participants grant upon making a Submission.

No Confidentiality of Contributions

No submission by any participant, including any written statement, slide deck, image, video, concept, idea, model, prototype, code, technical tool, user interface, or other material, whether directly submitted or linked by a submitted URL, (hereinafter “Submission”) will be treated as confidential. The Berkman Center, DPLA Steering Committee, DPLA Secretariat, or review panel members shall have no duty to maintain the confidentiality of, and shall not execute or be subject to any confidentiality agreement for, such Submissions.

Participants should not present, and the DPLA Beta Sprint and Steering Committee will not accept, any information in a Submission that is confidential, proprietary, or a trade secret. Participants should submit only Submissions that they are willing to have shared immediately with the Berkman Center, DPLA Steering Committee, DPLA Secretariat, or review panel members and made public if and when their Submission is selected for presentation at the public meeting. Participants must be prepared, in any follow-up discussions with the Steering Committee or review panel members regarding their Submission, to provide sufficient, non-confidential details and explanation about how their Submission works and upon what information it relies to allow the review panel meaningfully to evaluate their Submission.

License for Copyrighted Materials

Participants will retain copyright in their Submissions. By providing your Submission to the DPLA Beta Sprint, you are granting the Berkman Center, the DPLA Steering Committee, and the DPLA Secretariat a non-exclusive, no-charge, royalty-free, perpetual, irrevocable, and worldwide license to use your Submission for the purposes of carrying out the DPLA’s work and mission, including, without limitation, the license rights to sublicense, store, copy, reproduce, distribute, transmit, publicly display, publicly perform, encode, edit, translate, reformat, and prepare derivative works of your Submission or of any derivative work in any format or medium, and/or to incorporate it into a collective work. Participants may, with the prior written approval of the DPLA Steering Committee, effectuate the license granted upon making a Submission pursuant to this IP Policy through the use of an appropriate “open” license such as a Creative Commons license or the GPL that provides to the Berkman Center, the DPLA Steering Committee, and the DPLA Secretariat all the rights set forth above. You agree to execute agreements and other documents, upon reasonable request, that evidence or effectuate the license granted or other commitments you are making pursuant to this IP Policy by making a Submission.

By making a Submission, you warrant and represent that you either own or otherwise control all of the rights to that Submission, including, without limitation, all the rights set forth above.

The Berkman Center, DPLA Steering Committee, DPLA Secretariat, and review panel members shall have no obligation to publish, disseminate, incorporate in DPLA reports or materials, or make any other use of any Submission.

Participants agree to indemnify and hold harmless the Berkman Center, DPLA Steering Committee, DPLA Secretariat, review panel members, and each of their affiliates, subsidiaries, officers and directors, agents, employees, and partners from any third party claim or demand, including reasonable attorneys’ fees for damages and/or costs due to or arising out of the Participant’s breach of any license, agreements, commitments, representations, warranties, or obligations under this IP Policy.
