“Another factor lies behind the low voter turnout – a slowly growing crisis of legitimacy in Germany. This crisis is not based on limitations of civil rights. It is based rather on the voters’ false impression that ‘politics’ are to blame for the ending of the benefits of German social welfare, as though this was due to a failure of political good will or ability. In reality, the problem lies with the society as a whole, and its fear of the risks that the future holds. A mindset characterized by cautious conservatism has to some extent made the country ungovernable, and with that conservatism a feeling of dissatisfaction is abroad in the land, a feeling that would be directed at the opposition parties if they were in power.”

„Hinter der hohen Wahlenthaltung steckt jedoch mehr – eine schleichende Legitimitätskrise der Bundesrepublik. Sie gründet nicht auf Einschränkungen der Bürgerrechte, sondern auf dem falschen Eindruck der Wähler, ‚die Politi’“ sei schuld daran, dass die sozialen Wohltaten der Vergangenheit nicht mehr fließen werden: als mangelte es ihr an gutem Willen oder handwerklichem Können. In Wirklichkeit ist es die Gesellschaft als Ganzes, die sich ängstigt vor den Risiken der Zukunft. In solchem Gemütskonservatismus ist eine Unregierbarkeit des Landes angelegt, und mit ihm wächst der Unmut des Wählers, der auch eine unionsgeführte Regierung treffen würde.”

“The election victory of the opposition Christian Democratic Union did not necessarily reflect the majority’s approval of that party’s platform, of which little is even known. That victory was a measure of the German voters’ dissatisfaction with the inscrutable reform laws the Social Democrats have produced and the inescapable and unreasonable demands those laws impose. Even in mature democracies, the average voters think first of all about their wallets.”

“Of course the ruling Social Democrats in Berlin were expecting losses in the recent elections in the state of Thuringia, just as they had experienced losses in the European election some weeks ago. However, being finished off like a worthless political relict with 14.5 percent of the votes in the very state where the German Social Democratic party was founded shocked them more than the results of the European election. That election involved a nation-wide electorate that is sick and tired of Europe. It must have depressed the Social Democrats even more that the PDS – the successor to the former East German Communist Party – managed to gain nearly 25 percent of the vote (30 percent in the state of Brandenburg) despite the fact that a large number of its candidates were known to have had ties to the Stasi, the former East German state secret police. Gains by the PDS, moreover, were due to more than just the populist strategy that the party adopted.”

„Natürlich hatte die sozialdemokratische Führung Stimmenverluste in Thüringen ebenso einkalkuliert wie bei den Europawahlen. Doch dass sie im Land ihrer eigenen Parteigründung, in Thüringen, mit einem Stimmanteil von 14,5 Prozent abgefertigt wurde wie ein politisches Relikt ohne Wert, hat sie mehr schockiert als die gesamtdeutsche Absage eines europamüden Wahlvolkes. Dass obendrein die PDS mit Stasi-belasteten ostdeutschen Landeslisten fast ein Viertel aller Wähler überzeugte (in Brandenburg gar 30Prozent), muss nicht nur wegen der populistischen Strategie der SED-Nachfolgerin bedrücken.”

“The murdered man’s son, Teun de Groot, says about Boere, ‘If only he’d be forced to spend a couple of years in jail for what he did, or even one year. That would bring some satisfaction. Yes, that would mean a lot to me. And not only to me but to a lot of other people as well. I know that for sure.’
“The son of the victim, though, is unlikely to find there’s much justice in the German justice system. And the murderer won’t find much either.”

“And that certainly can take time. It’s only now that the German justice system wants to have a closer look at the files on Boere. Meanwhile, the murderer himself regrets nothing. In an interview on Dutch television, Boere was asked whether he was, in spite of everything, proud of having been a member of the ‘Silver Pine’ group, and he replied, ‘Yes, of course. We did everything we could to eliminate the enemy. That’s just how it was – feeling German as I did. I was obliged to fight for our cause. That’s what we did at the front, so why not here? It was the same thing’.”

Boere noch einmal im holländischen Fernsehen, auf die Frage, ob er trotz allem stolz darauf war, Mitglied dieser Gruppe gewesen zu sein: ‚Ja, selbstverständlich, wir haben doch alles Mögliche getan, um den Feind wegzumachen. Das war nun einmal so, ich fühle mich doch als Deutscher. Ich war verpflichtet dafür zu kämpfen. Wir haben das an der Front gemacht und warum auch nicht hier, das ist doch dasselbe’.”

Germany’s Special Kind of Justice Can Be Found Everywhere in the Country, and Not Just at the Technical University of Munich – 11
“Even after the nineteen-fifties the German justice system remained inactive in these cases. ‘Silver Pine’ killers like Boere ought to have been brought to trial in Germany at that time, but only now is the Aachen district attorney taking any action, and only after the Netherlands applied for court-ordered enforcement of the law. However, criminal law experts say that the chances of success are slim. The procedural hurdles are simply too great.”

„Auch nach den fünfziger Jahren bleibt die deutsche Justiz untätig. Die Silbertannenmörder wie Boere müssen in Deutschland vor kein Gericht. Erst jetzt wird die Staatsanwaltschaft Aachen aktiv, nach einem neuen Antrag Hollands, diesmal auf Vollstreckungshilfe. Die Chancen dafür, sagen Strafrechtsexperten, sind gering, die Verfahrenshürden zu groß.”

Germany’s Special Kind of Justice Can Be Found Everywhere in the Country, and Not Just at the Technical University of Munich – 10
“Professor Christiaan F. Rueter of the University of Amsterdam explains how this situation came about: ‘The Germans in power, especially in the nineteen-fifties, wanted it that way. There was a great feeling of chumminess and comradeship among people who’d fought together in the war. They all stuck together, and naturally they didn’t want their companions in battle – who originally had a citizenship other than German – to be handed over to a country where they might be imprisoned for life. Or at least for fifteen years or so’.”

„Warum das so ist, erklärt Prof. Christiaan F. Rüter, Universität von Amsterdam: ‚Vor allem in den fünfziger Jahren hat das den Deutschen, die damals an der Macht waren, durchaus gefallen. Denn es gibt da eine große Kumpanei und Kameraderie von Leuten, die zusammen gekämpft haben. Und die halten zusammen, und die wollen natürlich nicht, dass ihre Kampfesgenossen – ursprünglich anderer Staatsangehörigkeit – in das Land ausgeliefert werden, wo sie zu lebenslänglich verurteilt sind. Oder wenigstens ihre 15 Jahre dann absitzen müssten’.”
