“Commentary: We’re on our way to France. Patrick Faucheron, a Frenchman, has been living in Germany for thirty years and flies regularly back and forth between the two countries. He thinks the idea of a ‘reliability investigation’ is absurd.
“Patrick Faucheron, French amateur pilot: ‘I’ve been flying for more than twenty years, and when I started, I had to do an exam to verify my flight training. Now I’ve got this letter from the German authorities. I’m supposed to be examined once more on suspicion that I might commit a terrorist act. The whole world’s upside down, as far as I’m concerned’.
“Faucheron understood what he had to do. He got a new pilot’s license at this flight school here in Alsace. Because the school is in France, he simply gave his name and address. That’s all. And now, since French pilot’s licenses are valid in Germany, Faucheron can fly back and forth between France and Germany just as he always did, but with no German ‘reliability investigation’.”

„Unterwegs nach Frankreich. Schon seit über 30 Jahren lebt Patrick Faucheron in Deutschland, fliegt regelmäßig zwischen den beiden Ländern hin und her. Doch die Idee mit der Zuverlässigkeitsüberprüfung hält der Franzose für abwegig.
O-Ton: Patrick Faucheron, französischer Hobbypilot: ‚Ich fliege seit über 20 Jahren, ich wurde damals geprüft für die Fliegerausbildung und jetzt bekomme ich ein Schreiben von meinem Amt. Ich soll also jetzt auf Terrorverdacht überprüft werden und da verstehe ich die Welt nicht mehr.’
Der französische Pilot hat die Konsequenz gezogen. Er erwirbt die Fluglizenz hier in der elsässischen Flugschule einfach noch mal: Name, Adresse, mehr muss man dafür in Frankreich nicht angeben. Dann kann er wieder nach Deutschland fliegen, ganz ohne Zuverlässigkeitsüberprüfung.“

“Sybille Glaessing-Deiss of the German branch of the Aircraft Owners and Pilots Association: ‘Only those individuals who acquired their pilot’s license in Germany are affected by the new requirement. There are many German pilots, though, who have a license that was granted by some other country, and such a license is valid in Germany. And of course there are many foreign pilots with foreign licenses also valid in Germany. Anyone holding such a pilot’s license – registered in a country other than Germany – is exempt from undergoing the new ‘reliability investigation’. They’re free to fly anywhere in Germany they want, and they might or might not be terrorists’.”

“Commentary: A grotesque situation, and one with its own mad logic: without a private pilot’s license Major Schulz could not fly his own plane. Civilian bureaucrats would consider him a security risk. However, in his capacity as a member of an AWACS crew under the authority of NATO, he is expected to patrol the skies over those small airports from which a pilot who really is a security risk might take off. Nowhere else in Europe – only in Germany – does such a situation exist. The German branch of the Aircraft Owners and Pilots Association has so far been successful in two court actions against the new ‘reliability investigation’.”

„Eine Groteske mit Methode: Ohne seine Lizenz dürfte der Major als Sicherheitsrisiko privat hier nicht starten, im Dienst aber den kleinen Flughafen mit seiner AWACS aus der Luft überwachen. Der Fliegerverband AOPA hat sich bereits zweimal erfolgreich vor Gericht gegen die Überprüfung gewehrt, die es außer in Deutschland nirgendwo in Europa gibt.“

“Commentary: ‘Major Raymond Schulz, however, refused to apply to have himself investigated again by the civilian authorities. He stated, “I’ve been a Luftwaffe officer in NATO for the past twenty-five years. I’ve flown 5,000 hours on the E-3A-AWACS aircraft; I even flew missions over the United States after 9/11, for which I received a medal from Secretary of Defense Rumsfeld and President Bush”.’
“The German civilian authorities replied: ‘If in fact you refuse to make the required application, we will, unfortunately, be forced to invalidate your civilian pilot’s license. You really wouldn’t want that, would you?’”

„Major Raymond Schulz aber weigert sich und schreibt der Luftfahrtbehörde: ‚Ich bin seit 25 Jahren NATO-Luftwaffenoffizier, ich habe 5.000 Flugstunden an Bord der E-3A-AWACS und habe nach dem 11.9. in den USA Einsätze geflogen, dafür von Herrn Rumsfeld und President Bush sogar eine Medaille bekommen.
Die Behörde antwortet: ‚Sollten Sie sich tatsächlich weigern, den Antrag zu stellen, bin ich leider gezwungen Ihre Privatpilotenlizenz zu widerrufen und das wollen Sie doch nicht wirklich, oder?’“

“Wolfgang Ulrich, amateur pilot: ”I gave them a sworn statement, in writing, in which I stated that I had not committed any criminal offenses and that there were no outstanding court proceedings against me in Saudi Arabia.’
“Frontal 21 Reporter: ‘And that was enough?’
“Wolfgang Ulrich: ‘Right. That was enough then. So now I’ve undergone the investigation.’
“Frontal 21 Commentary: ‘German officials are thorough. Not even a German AWACS crew – the military personnel employed in NATO’s flying command centers – can escape their scrutiny. These Luftwaffe officers are responsible for patrolling and defending European air space and are well-trained for their work. They must also undergo the strictest of government background investigations.
“That’s not enough for German bureaucrats. If one of these officers flies his own private plane when he’s off-duty, then even he has to apply for the new “reliability investigation”’.”

„O-Ton: Wolfgang Ulrich, Hobbyflieger ‚Ich habe dann lediglich eine eidesstattliche Erklärung abgegeben, in schriftlicher Form, indem ich versichert habe, dass ich nicht straffällig geworden bin und dass keine Verfahren in Saudi-Arabien gegen mich vorliegen.’
Frage Frontal21: ‚Und das hat dann gereicht?’
O-Ton: ‚Wolfgang Ulrich, Hobbyflieger Genau richtig, das hat dann gereicht und nun bin ich zuverlässig geprüft.’
Deutsche Beamte sind gründlich. Nicht einmal die Besatzungen der AWACS, der fliegenden NATO-Kommandozentralen, sind vor ihnen sicher. Die Aufgabe der Offiziere: Überwachung und Verteidigung des Luftraumes – dafür sind sie bestens ausgebildet, unterliegen strengsten Sicherheitsüberprüfungen. Deutschen Beamten reicht das nicht. Fliegt ein Offizier privat, so muss auch er seine eigene Überprüfung beantragen.“

“But once the bureaucratic wheels are set in motion – once there is a requirement that someone or something undergo official registration – the process becomes unstoppable. Wolfgang Ulrich learned that very well. Ulrich is an amateur pilot who worked for the telephone company in Saudi Arabia for four years. German officials see something very suspicious in that. So, among other things, they demand that Ulrich obtain the following items from Saudi security officials – and we quote:
“ ‘1. Confirmation in writing from the authority of the country of foreign residence which corresponds to a local or state Office of Criminal Investigation in Germany that there exists no record of a criminal offense;
“ ‘ 2. Certification of the authenticity of the signature of the foregoing official by a higher authority in the country of foreign residence….’
“Wolfgang Ulrich, amateur pilot: ‘Even the German Foreign Office has admitted that there are no such government departments in Saudi Arabia like the ones the authorities here are referring to.’
“Reporter: ‘Written confirmation of something by government departments that don’t exist – obviously there’s no way Ulrich can obtain that. And just as obviously, in the eyes of the bureaucrats here, there’s no way he can be allowed to fly’.”

„Doch wenn ein bürokratischer Erfassungsapparat erst mal in Bewegung gerät, kann ihn niemand stoppen. Das erfuhr auch Wolfgang Ulrich. Der Hobbyflieger hatte vier Jahre für die Telekom in Saudi-Arabien gearbeitet. Sehr verdächtig, finden die Beamten und verlangen von Ulrich Erklärungen saudischer Sicherheitsbehörden unter anderem eine:

‚1. Bescheinigung der zuständigen Behörde des ausländischen Wohnortlandes (entsprechend dem Landeskriminalamt in der BRD), dass keine Erkenntnisse über Straftaten vorliegen;
2. Beglaubigung der Echtheit der Unterschrift des Beamten durch übergeordnete Behörden im ausländischen Wohnortland…’
O-Ton: Wolfgang Ulrich, Hobbyflieger: ‚Selbst dass Auswärtige Amt hat zugegeben, dass es solche Dienststellen nicht gibt, die hier nachgefragt wurden.’
Die Bescheinigung einer Behörde, die nicht existiert, kann Ulrich logischerweise auch nicht vorlegen – doch ohne darf er nicht fliegen.“

“The reason for the new ‘reliability investigation’ was the behaviour of a confused pilot in an ultra-light aircraft who flew in circles over Frankfurt’s banking quarter two years ago. The man triggered fear and horror when he suddenly appeared in the skies over the city. Luftwaffe interceptors were even scrambled, but in the end the supposed terrorist turned out to be just another harmless idiot. Still, the government saw fit to rush another new law into effect.”

„Anlass für die Zuverlässigkeitsüberprüfung war ein verwirrter Motorsegler, der vor zwei Jahren über dem Frankfurter Bankenviertel kreiste. Der Pilot eines so genannten Ultraleichtfliegers sorgte für Angst und Schrecken, als er plötzlich am Himmel erschien. Abfangjäger stiegen auf, doch der vermeintliche Terrorist entpuppte sich als harmloser Spinner. Trotzdem zimmerte Rot-Grün rasch ein Gesetz.“

“Manuela Damianakis, Berlin city administration: ‘It’s all a matter of decisions to be made in individual cases. There are also decisions that will involve a long administrative path, as it were. Every individual has an opportunity to express an opinion about a decision and can even go to court.’
“The law-abiding Dr. Manz doesn’t see why he should in the end have to go to court in order to maintain a valid pilot’s license. He refuses to make an application to have himself investigated, a process which – to quote current air safety legislation – involves, among other things:
“Questions forwarded to:
‘- the German Federal Criminal Investigation Agency,
‘- the German agency investigating cross-border crime,
‘- the German internal intelligence agency,
‘- the German central intelligence agency,
‘- German military intelligence,
‘as well as questions sent to the applicant’s current employer’.”

Jeder kriegt auch die Möglichkeit, sich zu dieser Entscheidung zu äußern, im Zweifelsfall auch vor Gericht zu gehen.’
Der rechtschaffene Arzt sieht nicht ein, dass er am Ende für seine Lizenz vor Gericht ziehen soll. Erst recht weigert er sich, seine eigene Ausforschung zu beantragen, die laut Luftsicherheitsgesetz unter anderem vorsieht:

“Commentator: Even the government air safety office in Berlin couldn’t really describe the criteria to be used in judging this aspect of a pilot’s behavior.”
