HELA Proportionality Event

Wednesday, October 29, 12:00 PM to 1:30 PM

The European Law Association (HELA) is sponsoring an event on proportionality on Wednesday, October 29, from 12 PM to 1:30 PM, which HLTF is co-sponsoring. The panel will include Prof. Grainne de Burca (visiting professor at HLS), who will discuss proportionality on the European Court of Justice, Prof. Dieter Grimm, a former President of the German Constitutional Court (visiting professor at HLS and Yale), who has written on proportionality in Germany and Canada, and Prof. Vlad Perju (assistant professor at BC Law and SJD graduate of HLS), who has written on the balancing of the Supreme Court.

Attached to this post are a recent paper by Vlad Perju defending proportionality analysis against the critique that proportionality ignores rights and gives too much leeway to judges, which he will discuss, and a paper by Martti Koskenniemi on the judgment of the High court in Israel on the occupation and the wall, to which the panelists will respond.

Our Hohfeld discussion (about article #2 on this list) will be postponed one week so that we don’t have two events on the same day. So we will discuss Hohfeld on Wednesday, November 5, 7 PM, location TBA.
