Dear Mr. Graf, dear friends,
The last sentence that Jean-Paul read last week from the sworn statement made by the young boy, Daniel Steiner, on 13 February 2000 was, “Even when Joseph was on the pool bottom, lifeless, the whole group that I just mentioned was standing together and laughing. The three boys left the group, and then they laughed.”
Jean-Paul continued reading the boy’s sworn statement: “The people in the group that was standing at the edge of the pool laughed and looked on without doing anything. Joseph was under the water for about six or seven minutes altogether. He lay on the bottom of the pool and didn’t come up again. Antonio Keleman came to me and said, ‘There’s somebody lying in the water.’ I said, ‘It’s Joseph.’ Just where Joseph was lying on the bottom, the bubbling water was turned on.
“And the two of us ran over there. The group I just mentioned was still standing there, but they didn’t do anything. They didn’t stop us when we jumped into the water and got Joseph out. The group also stayed there until the doctor came, then they broke up. Frau Shuster went away with Ute Schneider. I saw that really clearly. When Joseph was on the bottom, near the edge of the pool, the heavy-set attendant who was standing at the control room looked on from where she was, far away, without doing anything.
“Herr Goldschmidt, the man in charge of the swimming pool, came riding his bicycle before the doctor arrived. He leaned the bicycle on the wall of the machine room, where the ambulance drove in. Joseph lay there a pretty long time before the ambulance came. Frau Kantelberg, Joseph’s mother, came right after the ambulance, about two minutes after. I saw Diana come to her brother. I saw them take Diana away, and I saw the doctor treating Joseph. Some vomit came from his mouth then, it was white and foamy. I’m sure it was foamy. Joseph didn’t move any more when he was lying at the edge of the pool, Antonio Keleman and I pulled him out. After they took Joseph away, I went home.
“I, Daniel Steiner, have read the above statement in the presence of my mother, in the presence of Diana, Joseph’s sister, and in the presence of her mother and I confirm it as a statutory declaration.”
“Then,” said Jean-Paul, “it says: ‘Signed on Saturday, 29 April 2000’ and below that is Daniel Steiner’s signature and the sentence, ‘Read and approved. Daniel’s mother and legal guardian, Frau Annerose Steiner,’ with her signature.”
“But if Daniel Steiner retracted this statement during the police questioning,” I asked, “isn’t that proof that the statement was false?”
“Daniel Steiner made the same statement before a judge and a district attorney. So the retraction, in my opinion, was proof that he was afraid of the people who beat up his brother. Or it’s proof that Daniel was put under pressure by the police, who were themselves under pressure from their superiors, who wanted the incident to be classified an accident.”

Sehr geehrter Herr Graf, sehr geehrte Freunde,
der letzte Satz, den Jean-Paul letzte Woche aus der Eidesstattlichen Versicherung vom 13.02.2000 von dem kleinen Jungen Daniel Steiner vorgelesen hat, lautete, „Auch wie Joseph leblos auf dem Beckengrund, stand die ganze oben genannte Gruppe zusammen und lachte. Die drei Jungen sind dann raus zur Gruppe und haben dann gelacht“.
Jean-Paul fuhr fort, die Eidesstattliche Versicherung vorzulesen: „Die zur Gruppe gehörenden am Beckrand stehenden Personen lachten und sahen tatenlos zu. Joseph lag insgesamt ungefähr 6 bis 7 Minuten unter Wasser. Er lag am Boden und kam nicht mehr hoch, auch nicht zwischendurch. Antonio Keleman kam zu mir und sagte: ‚Da liegt einer im Wasser.’ Ich habe gesagt: ‚Das ist bestimmt Joseph.’ Erst wo Joseph unten lag, wurde der Sprudel eingeschaltet.
Und wir beide sind hingelaufen. Die oben genannte Gruppe stand immer noch da, hat aber nichts gemacht. Sie hat uns nicht aufgehalten, als wir beide hinein sprangen und Joseph herausholten. Die Gruppe ist auch weiter dageblieben bis der Arzt kam, dann haben sie sich all aufgelöst. Frau Schuster ist gemeinsam mit Ute Schneider weggegangen. Das habe ich ganz genau gesehen. Als Joseph am Boden neben dem Beckrand lag, sah die dicke Aufpasserin, die am Kontrollraum stand, von weitem nur hin, ohne etwas zu unternehmen.
Der Bademeister Goldschmidt kam kurz vor dem Arzt mit dem Fahrrad rangeradelt. Er stellte das Fahrrad an die Mauer des Maschinenraumes, dort wo der Krankenwagen hereinfuhr. Joseph lag ganz schön lang herum bis der Krankenwagen kam. Frau Kantelberg, die Mutter von Joseph, kam ungefähr zwei Minuten nach dem Krankenwagen, ganz kurz danach. Ich habe gesehen, wie Diana zu ihrem Bruder kam. Ich habe gesehen, dass, als sie Diana wegzogen, und der Arzt sich um Joseph kümmerte, Erbrochenes aus dem Mund von Joseph kam, es war etwas weißlich Schaumiges. Ich bin ganz sicher, dass es schaumig war. Joseph hat sich, als er am Beckenrand neben dem Schwimmbecken lag, nie mehr bewegt, nachdem er von mir und Antonio Keleman herausgeholt worden war. Nachdem sie Joseph weggeschafft haben, bin ich heimgegangen.
Ich Daniel Steiner habe obige Aussage in Anwesenheit meiner Mutter, Diana der Schwester von Joseph und ihrer Mutter gemacht und bestätige sie eidesstattlich.“
„Dann“, sagte Jean-Paul, „steht es: ‚Unterschrieben, am Samstag, den 29.04.2000’ und es folgt die Unterschrift von Daniel Steiner und der Satz, ‚gelesen und genehmigt: Daniels Mutter als Erziehungsberechtigte, Frau Annerose Steiner’ mit deren Unterschrift.“
„Wenn aber Daniel Steiner während der Vernehmung von der Polizei diese Aussage widerrief“, fragte ich, „ist das nicht ein Beweis dafür, dass die Aussage falsch war?“
„Daniel Steiner hat vorher dieselbe Aussage vor einer Richterin und einem Staatsanwalt gemacht. Also, der Widerruf, meiner Meinung nach, war nur ein Beweis dafür, dass er Angst vor denjenigen hatte, die seinen Bruder geprügelt haben. Oder er ist ein Beweise dafür, dass Daniel unter Druck von den Polizeibeamten stand, die selbst unter Druck handelten, weil ihre Vorgesetzte wollte, sie sollten das Ereignis als einen Unfall bezeichnen“.
