Dear Mr. Graf, dear friends,
My friend continued reading the transcript of the interrogation of the then fifteen-year-old boy, Daniel Steiner:
“To begin with, Mr. Steiner was given the opportunity to make a statement about the facts of the matter. He was most emphatically told that his statements must conform to the truth and that he would be punished if he knowingly lied.
“Mr. Daniel Steiner was somewhat moved and became thoughtful. Then he was given an opportunity once more to describe the facts of the matter.”
My friend sighed. “I’m sure Daniel was ‘moved,’” he said with a trace of irony. “He had already often said that he was afraid of what the right-wing extremists would do to him if he told the truth about Joseph’s death, the extremists in the general population and the extremists among the police. However, now he’s told he’ll be ‘punished’ if he lies, although he knows that that was what the police want him to do.”
I was shocked that my friend could say that, but I said nothing. He continued reading:
“The interrogation was recorded on tape. Mr. Steiner agreed to that and we asked him to describe what happened, and everything that followed.
“So I was at the pool with a couple of buddies. Then we went into the water and came out and then Joseph and Diana came into the pool. Then they lay down in the area near the pool and then they also went into the small pool and came out again.
“I’ve mentioned the names. What should I do now?”
My friend remarked, “This is quite remarkable. Daniel asks, ‘What should I do now?’ We shouldn’t forget that on that same day, 26 November 2000, the three people that the police had arrested for Joseph’s murder had been set free. That means that this interrogation was taking place not only in the context of Daniel’s brother having been beaten by right-wing extremists, presumably, as the police themselves had said, because of Daniel’s earlier statements that Joseph had been murdered – in other words, no only in a context where Daniel felt threatened, where he was afraid of the right wing, as he had often said, where he was afraid of right-wingers among the police themselves, but also in the context of the release of the three suspects on that same day, 26 November 2000. No wonder Daniels answers were different from the answers at the earlier questioning before the judge in Dresden.”
My friend read Daniel’s question to us once again and continued reading the rest of the transcript:
“I’ve mentioned the names. What should I do now?
Question: Tell what happened. Tell what you remember about what happened and how that fits in with the names you just mentioned.”

Sehr geehrter Herr Graf, sehr geehrte Freunde,
mein Freund las das Protokoll der Zeugenvernehmung des Jungen Daniel Steiners, damals im Alter von fünfzehn Jahren, weiter vor:
„Zu Beginn wurde Herrn Steiner Gelegenheit gegeben, Äußerungen im Sachverhalt zu machen. Er wurde nochmals eindringlich darauf hingewiesen, dass er wahrheitsgemäße Aussagen sein müssen (sic!) und strafrechtliche Verantwortlichkeiten zur Folge haben kann, wenn man bewusst die Unwahrheit sagt.
Herr Daniel Steiner war leicht gerührt und in sich gekehrt. Ihm wurde jetzt Gelegenheit gegeben, den Sachverhalt nochmals zu schildern“.
Mein Freund seufzte. „Ich bin mir ganz sicher“, sagte er mit einem ironischen Anflug, „dass Daniel ‚gerührt’ war. Er hatte schon oft gesagt, dass er Angst davor, was die Rechten ihm antun würden, die Rechten unter der Bevölkerung und die Rechten unter den Polizisten, wenn er die Wahrheit über Josephs Tod sagen würde. Eine Lüge aber kann ‚strafrechtliche Verantwortlichkeiten zur Folge haben’, obwohl er weiß, dass das ist es, was die Polizei jetzt hören will“.
Ich war schockiert, dass mein Freund das sagen könnte, aber ich sagte nichts. Er las weiter vor:
„Die Vernehmung wird auf Tonband aufgenommen. Herr Steiner ist damit einverstanden und jetzt bitten wir darum, das zu schildern, wie das damals bzw. in der Folge alles gelaufen ist.
Also ich war zu dem Zeitpunkt im Bad mit ein paar Kumpels. Dann sind wir ins Wasser gegangen und wieder raus und dann kam (sic!) der Josef und die Diana ins Bad. Dann haben die sich an den Liegeplatz gelegt und dann sind die auch mal ins kleine Becken gegangen und dann wieder raus.
Ich habe ja gesagt, die Namen und so, wie soll ich jetzt machen?“
„Das ist ja merkwürdig“, sagte mein Freund. „Daniel fragt, ,Wie soll ich jetzt machen?’ Wir sollten auch nicht vergessen, dass am diesen Tag, dem 26.11.2000, die drei Menschen, die die Polizei wegen Josephs Mord verhaftet hatte, freigelassen worden sind. Das heißt also, nicht nur dass diese Vernehmung in einem Zusammenhang, wo Daniels Bruder von Rechten geschlagen worden war, vermutlich, so die Polizei, wegen Daniels früherer Aussage, dass Rechte Joseph ermordet hatten – nicht nur in einem Zusammenhang also, wo Daniel sich gedroht fühlte, wo er Angst vor den Rechten hatte, wie er oft gesagt hatte, wo er Angst vor Rechten unter den Polizeibeamten hatte, sondern auch in dem Zusammenhang der Freilassung der drei Verdächtigen an diesem Tag, dem 26.11.2000. Was Wunder, dass Daniels Antworten bei dieser Vernehmung ganz anders sind, als bei der früheren Vernehmung vor der Richterin in Dresden.“
Mein Freund las Daniels Frage noch einmal vor und fuhr fort, den Rest des Protokolls vorzulesen:
„Ich habe ja gesagt, die Namen und so, wie soll ich jetzt machen?
Frage: Was dort abgelaufen ist. An was du dich erinnerst, was dort abgelaufen ist und dann, wie das mit den Namen zusammenhängt.“
